Disputes over property ownership due to informal documents (qolnameh) have long been a major issue in Iran’s real estate market. The new Law on Mandatory Official Registration of Real Estate Transactions, along with its dedicated claim registration system, is designed to bring order to this chaos.
The Deputy for Property and Cadastre Affairs at the State Organization for Registration of Deeds and Properties has clearly stated that registering claims by two or more individuals for the same property is completely allowed and presents no obstacle. This clarification has eased concerns for many citizens.
How to Register a Claim – Step by Step The process has been simplified for public access:
Prepare a geo-referenced map of the property through the “Shamim” system and authorized surveyors.
Scan and upload supporting documents (informal contracts, etc.).
Complete basic information fields.
The system even accepts maps prepared by the claimant or their acquaintances if they are qualified surveyors.
Handling Multiple Claims on One Property When multiple claims are filed for the same property, all are reviewed simultaneously by the competent authority. A decision is issued in favor of one party, and others have the legal right to appeal within the specified period. This ensures fair and transparent resolution.
Penalties for False Claims To prevent abuse, the law imposes strict penalties. Anyone filing a false claim must pay a fine equal to 20% of the property’s real value. If forgery (such as fake contracts) is proven, criminal liability for forgery will also apply.
Key Benefit: Making Official Deeds Incontestable Previously, even buyers with official deeds lived in fear of future challenges based on informal documents. Under the new law, anyone with a claim must register it in the system within a two-year deadline (starting June 2025 for cadastral deeds issued since 2017). After this period, unregistered claims will no longer be accepted, significantly strengthening the legal security of official documents.
